Telstra Duct Access Expert Witness, Australia

The problem

Telstra Corporation Limited (Telstra) owns the Australian copper network. It faced arbitration proceedings before the Australian Competition and Consumer Commission (ACCC) because of alleged overcharging for access to its telecommunications ducts. A competitor using Telstra’s ducts argued that the access charges amounted to anti-competitive conduct.

How we helped

We prepared an independent expert report that assessed the reasonableness of Telstra’s methodology for pricing its wholesale duct access product. After analyzing the effect of Telstra’s and alternative methodologies on competition, we concluded that Telstra’s approach to calculating the cost of the duct network is appropriate.

Impact

The ACCC agreed with Castalia’s analysis, and concluded that Telstra’s contract to provide telecommunications duct access was reasonable and should remain in force.
